Areas Served

The Middle District of North Carolina is divided into three Divisions for purposes of assigning bankruptcy cases to Trustees and locations for Section 341 Creditors Meetings and court hearings. The assignments of Divisions to the counties of the Middle District, for purposes of allocating bankruptcy cases for processing, are as follows:

If the debtor's county of residence (as reflected in the bankruptcy petition) is one of those named above, the case will be assigned to its designated Division (absent effective arrangements with the Court to the contrary). If the debtor's county of residence is outside the Middle District, the case will normally be assigned to the Division to which that county is most closely geographically located. All counties of debtor's residence located in the Eastern District of North Carolina will normally be assigned to the Durham Division; all counties of debtor's residence located in the Western District of North Carolina will normally be assigned to the Winston-Salem Division. [A listing of all North Carolina counties, with their respective Middle District Division assignments is available by clicking here.]

If the debtor's county of residence is located outside the state of North Carolina, the case petition and schedules will be examined to determine the most appropriate Division to assign to the case. Attorneys filing cases whose county of debtor's residence falls into this category are encouraged to contact the Clerks Office prior to or at the point of case filing to assist the Clerks Office in determining the initially most appropriate Division to assign to the case.
