Hearings for Uncontested Motions and Applications with “No Objection/ Comments” ECF Event from Chapter 13 Trustee
For uncontested motions or applications set for hearing on the chapter 13 calendar, counsel for the debtor will not be required to appear, provided that all the following conditions are satisfied:

The chapter 13 trustee dockets a “No Objection/Comments” ECF event;

No other responses or objections are filed; and
-
Chambers has not put a “Comment” on the docket by 12:00 p.m. the day prior to the scheduled hearing directing counsel to appear.
In those circumstances, debtor’s counsel is not required to appear at the hearing and may instead stand on his or her papers. Counsel’s non-appearance will be interpreted as agreement to any recommendations contained in the Trustee’s ECF event and Judge James may grant the relief sought with those recommendations incorporated into the Order.

All hearings before the Bankruptcy Court for the Middle District of North Carolina will be scheduled as in-person hearings. Subject to public health emergencies or other exigent circumstances that may limit in-person attendance, alerts for which would be posted to the Court’s website, the Court expects that parties and attorneys will appear in person at hearings. However, in certain, limited circumstances described herein, the Court may permit counsel or parties in interest to appear by video conference through Zoom for Government (“ZFG”).
