Judge Kahn does not engage in any kind of communication with parties before the Court except on the record in the courtroom and through documents filed with the Clerk or Court and orders entered by the Court. Ex parte communications with the Court about matters affecting a case are prohibited. See Fed. R. Bankr. P. 9003. Administrative matters, including requests for continuances, should be addressed to Judge Kahn’s Courtroom Deputy, Karen Champagne. Ms. Champagne, like all members of the Clerk’s office, may not give legal advice. DO NOT write letters to, email, or call Judge Kahn or his law clerks regarding cases. Failure to comply with this rule may result in sanctions. Except in unusual circumstances, each letter or e-mail addressed to Judge Kahn or his law clerks or otherwise sent to the Court and identifying a particular case or proceeding, will be placed on the relevant docket and made part of the public record. Any such letter or e-mail may be set for hearing.
Zoom Appearance Procedures for Judge Kahn
Beginning in July 2021, all hearings before the Bankruptcy Court for the Middle District of North Carolina will be scheduled as in-person hearings. Judge Kahn will retain the ability for parties and counsel to attend by means of video appearance, but only upon request and only in certain, very limited circumstances. All requests to deem a hearing Zoom Eligible must be done through the procedures contained in the document below, which may be periodically updated or modified as need arises.
