Changes to Bankruptcy Fees and Forms Effective June 1, 2014

At its March 2014 meeting, the Judicial Conference approved amendments to the Bankruptcy Court Miscellaneous Fee Schedule. New filing fees for bankruptcy cases and for filing a complaint in an adversary proceeding will be effective June 1, 2014. The administrative fee associated with filing a bankruptcy case (which is included in the total fee) was formerly $46 for each chapter. On June 1, 2014, the administrative fee will be raised to $75 for chapters 7, 12, 13, and $550 for chapters 9, 11, 15.

Electronic Filers should update their case filing/preparation software to prevent payment processing errors.

Filing Fees Effective June 1, 2014:

  • Chapter 7 - $335
  • Chapter 9 - $1,717
  • Chapter 11 - $1,717
  • Chapter 12 - $275
  • Chapter 13 - $310
  • Chapter 15 - $1,717

The fee for motions to split a joint debtor case for individuals for chapters 7, 11, 12, 13 will be the same as this new filing fee.

The fee for filing a complaint in an adversary proceeding is being raised to $350 from $293, which is the same as the filing fee for a civil case in district courts.

Amendments to Official Bankruptcy Form 3B (Application to Have the Chapter 7 Filing Fee Waived) and Directors Procedural Form B200 will take effect on June 1, 2014, to reflect the increase in the administrative fee for bankruptcy cases.
